This article is organized in three sections: in the first it comments the impact that the different deregulation options may have going from timid liberalization to more radical options like the British. The second one analyzes service related aspects. The solutions to these problems should guarantee that the public sector should not have to cover from its budget the possible failures of the private agents or the ones transferred to other administrations; in such a way that the regulator – FOMENTO in Spain- develops an orderly de-regulatory process, coherent and viable. Finally, the third section establishes some final recommendations about some strategies to develop this process for passenger rail services. And we say that in case of being implemented Is it in moments of crisis the best opportunity to implement this type of services?
